Article 48.1 a) of Law 5/2014, of April 4, on Private Security, states literally:
“The services of private investigation, carried out by private detectives, shall consist of conducting the necessary inquiries to obtain and provide, on behalf of third parties with legitimate interest, information and evidence about private conduct or facts related to the following aspects:
a) Those related to the economic, labor, commercial, financial sectors, and, in general, to personal, family, or social life, except for those occurring in residences or reserved places.”
Article 265.1.5 of Law 1/2000 of Civil Procedure states:
5th. Reports prepared by legally authorized private investigation professionals concerning relevant facts on which they base their claims. If these facts are not acknowledged as true, testimonial evidence will be taken.”
The Supreme Court recognizes private detectives as qualified witnesses in judicial proceedings, and the Civil Procedure Law regulates the interrogation of the detective during the process, limiting it to the facts reflected in their report.
